Injuries to Children

We fight to get families the justice they deserve

Children and infants are among the most vulnerable members of our society, and we all have a shared responsibility to keep them safe. An injury to a child is a parent’s worst nightmare, leading to weeks, months or even a lifetime of hardship. When children are involved in accidents, they can suffer injuries that heal improperly or leave them permanently disabled, not to mention emotional trauma.

Moving on in the wake of an injury to a child is always difficult, but if the injury was due to someone else’s negligence, the law does provide for compensation. For many families, recovering damages can pay for procedures and services that reduce the long-term impact of an injury. However, in order to get that compensation, you’ll need a capable attorney on your side.

At Flager & Associates, PC, we’ve been representing families in Philadelphia and throughout eastern Pennsylvania for decades. If your child has been injured, you can’t afford to lose. That experience matters.

Playground Accidents

Defective Toys

Children may fall down because a negligent property owner failed to clear or fix a hazard. They may get exposed to dangerous products or get hurt because an adult failed to supervise them properly. The very products that are designed to protect children, including car seats, unfortunately can injure them due to design or manufacturing defects.

If your child sustained an injury, you may be entitled to compensation. Our firm can advocate for your child’s rights. Contact Flager & Associates, PC for the experienced legal help your family deserves. Call us today for a free case evaluation.

Playground Accidents

A child’s playground accident could be the result of poorly maintained equipment or poor supervision by adults. Playground accidents may result in a variety of severe injuries, including spinal cord injuries as well as broken bones that may heal improperly in the years to come.

Playground maintenance should never be neglected by schools, recreation facilities, municipal parks, or child care centers. Unfortunately, neglect sometimes happens, and we have seen tragic results. Some examples of playground neglect include:

  • Inadequate padding below climbing structures
  • Improperly secured swings
  • Inadequate clearance to allow children to pass around swings
  • Loose bolts or fasteners
  • Rotting flooring or fencing on climbing structures

Other playground injuries are the result of poor supervision. For example, an adult might allow a game of tag to take place around a swing set, leading to a swing striking a child in the head.

After a playground injury, you may be entitled to compensation through a premises liability claim against the owner or manager of the playground. Our experienced attorneys will be happy to discuss the details of your case and help your family fight for justice.

Dangerous Toys

Toys, when they are safe, bring much happiness to children. When you have dangerous toys in your home, they can bring heartbreak to parents if children suffer injuries. Accidents happen, but sometimes, toy makers put the “bottom line” over the health and safety of children. When their actions cause injury, the manufacturer, and possibly other entities, need to be held responsible. There are no excuses for harmful products that put children in danger. You deserve justice. We can help.

There are many ways a defective toy can harm a child. For example, a loud toy may cause hearing damage. A pool toy may result in a swimming accident. A few other examples of hazards from dangerous toys include:

  • Strangulation hazards such as cords, straps, and laces
  • Small parts or anything young children can put into their mouths that cause choking hazards
  • Cuts caused by sharp edges and points
  • Improper labeling regarding age appropriateness of toy
  • No warnings of choking hazards
  • Lead poisoning from paint on a toy ingested by your child

If your child has been injured by a defective toy or other product, you may have a product liability claim against the manufacturer. Contact our firm today, and one of our veteran attorneys will review the facts of your case. We’ll do everything in our power to get you the compensation you need to move forward.
